Applying to these Ads may not make sense, if companies find a qualified US worker, they may simply close the job order by not sponsoring the Alien.

How to identfy these GREEN CARD Ads which turn you BLUE: Most of these ads normally talk more about Education, Major Field of Study, Experience, Heavy Travel   Requirement and Acceptance of Foreign Equivalent education.

Example:

Job Description: Abnormal and multiple skills (Java Developer with Oracle DBA skills)

Education: BS degree with 5 years of Experience or MS Degree with 2 Years of Experience in Computer Science, Information Technology, Management Information Systems, Any Engineering (And sometimes no relation - Finance or Commerce) and Foreign Equivalent Accepted. Employer will accept any suitable combination of education and experience.
 
Employer will accept a 3 year BS degree in lieu of a  4 year BS degree (This is a job for Green Card Process for sure)

Number of positions: 5 (what??)
Travel: Extensive Travel (why??)
Employer Location: NYC
Job Location: CA (How??)

How many hours is full-time employment? How many hours is part-time employment?

The Fair Labor Standards Act (FLSA) does not define full-time employment or part-time employment. This is a matter generally to be determined by the employer. Whether an employee is considered full-time or part-time does not change the application of the FLSA.

This means even if an Employer - Employee agrees at 30 Hours a week as a Full time, it is full time Employment. This may also apply to H1B Workers.

This is a common feeling for most of EAD card holders, whose I-485 Adjustment of Status is pending. "I have an EAD Card and I don't have to renew the H1B" - "I can work directly, eliminating the Consulting Company or get a Permanent Position"

Why should someone with an Employment Authorization Document (EAD) not use it, but instead keep renewing their H-1B status?

Let's look at a situation: Your I-140 is approved and I-485 is pending and you may not get Adjustment of Status immediately, since Visa Numbers are not available. 

  • Are you 100% sure that you have never violated Status? 
  • Did you have paystubs for all the time you were on H1B?
  • Are there any black holes that may cause the I-485 to get denied?
  •  Have you any guarantee that the I-140 Petitioner was not black listed,  forcing USCIS to perform an Administrative Revokation?
(This may even result is revoking your I-485 Petition)

There is no guarantee that your I-485 (Green Card) will be approved. Atleast, if you maintain your H1B Status, you can begin the GC Process from scratch is there is a denial. If your H1B is expired, you can not go back in time and re-apply for H1B. One possibility might be that you stay out of the United States and apply for an H1B as a Freshman.

Section 245(k) allows anyone who is out of status for 180 days to obtain a Green Card. If you plan NOT to extend H1B, you must look back and check your H1B Records including Paystubs, I-140 Petitioner's current record.Com

Another reason to continue to renew one’s H-1B status is USCIS’ questionable interpretation of section 245(k). If a person’s application for adjustment of status is denied for any reason, the USCIS holds that the person may not renew their I-485 unless they have maintained their lawful “nonimmigrant” status while their application for adjustment of status is pending. In such cases, persons are often forced to leave the U.S. simply due to their failure to extend their H-1B status.

Hey, make a wise decision, you never know how and when your H1B Status will come to your rescue. It is always a good idea to maintain H-1B status until the application for adjustment of status is approved.
